The customer is responsible for providing accurate information and reviewing the requirements before work begins.

- Graphic design;
- Branding;
- Packaging design;
- Social-media graphics;
- Printing artwork;
- Signage artwork;
- Web-design graphics;
- Other customized creative work.
The scope, price, number of concepts, revisions and delivery timeframe may vary depending on the project.
Where a quotation or project agreement specifies different terms, those terms will apply to that particular project.
9. QUOTATIONS AND ESTIMATES
Quotes and estimates provided by Bright Eagle Graphic Creations may be based on the information available at the time of quotation.
A quotation may specify:
- Description of the work;
- Quantity;
- Materials;
- Specifications;
- Design requirements;
- Production costs;
- Delivery costs;
- Applicable taxes or charges;
- Estimated completion time;
- Payment requirements.
Unless otherwise stated, quotations may expire after the period specified in the quotation.
Changes to the customer’s requirements after a quotation has been accepted may result in additional charges.
10. DESIGN APPROVALS AND CUSTOMER RESPONSIBILITY
Before printing, production or final publication of customer-approved artwork, the customer is responsible for carefully checking:
- Spelling;
- Names;
- Telephone numbers;
- Email addresses;
- Website addresses;
- Dates;
- Prices;
- Measurements;
- Colours;
- Images;
- Logos;
- Contact details;
- Other content.
Once a customer approves artwork for production, the customer accepts responsibility for the approved content.
We are not responsible for errors contained in artwork that the customer has approved, particularly where the error could reasonably have been identified during the approval process.
Where we identify an apparent error before production, we may bring it to the customer’s attention, but final responsibility for customer-provided content remains with the customer.
11. REVISIONS TO DESIGN WORK
The number of revisions included in a design project may depend on the quotation or service agreement.
Additional revisions or significant changes outside the agreed scope may attract additional charges.
A substantial change to the original brief may be treated as a new design requirement.
Examples include:
- Changing the entire concept;
- Requesting a different design direction;
- Changing the intended product;
- Changing dimensions after design completion;
- Requiring additional design variations;
- Replacing previously approved content.
12. CUSTOMER-SUPPLIED MATERIALS
Customers may provide photographs, logos, text, artwork, documents, trademarks or other materials for use in a project.
You represent that you have the necessary rights, permissions or authorization to provide and use those materials.
You must not provide material that:
- Infringes copyright;
- Infringes trademarks;
- Violates another person’s rights;
- Contains unlawful material;
- Is defamatory or fraudulent;
- Violates applicable laws.
The customer remains responsible for claims arising from materials that the customer supplied and authorized us to use.
13. INTELLECTUAL PROPERTY
Unless otherwise agreed in writing, Bright Eagle Graphic Creations retains ownership of its pre-existing design concepts, templates, techniques, processes, source materials, working files and other intellectual property.
For custom projects, the customer’s rights to the final approved design or deliverable will depend on the agreement for that particular project and whether the project has been fully paid for.
Payment for a design service does not automatically transfer ownership of every working file, concept, draft or unused design concept.
Where editable/source files are specifically requested, their release may be subject to additional terms or charges.
14. CUSTOMER TRADEMARKS AND COPYRIGHT
Customers retain their rights in trademarks, logos, photographs, text and other intellectual property that they provide to us, subject to any separate agreement.
By providing such materials, you grant Bright Eagle Graphic Creations permission to use them to the extent reasonably necessary to provide the requested service.
You remain responsible for ensuring that the materials you provide do not infringe third-party rights.
15. PORTFOLIO AND MARKETING USE
Unless otherwise agreed in writing, Bright Eagle Graphic Creations may wish to display completed design work in its portfolio, website, social-media pages or promotional materials to demonstrate our work.
Where a project contains confidential information or the customer has specifically requested that the work remain confidential, we will take reasonable steps to respect that requirement.
Customers who require strict confidentiality should notify us before work begins.
16. PAYMENT
Payment terms depend on the product or service being purchased.
For certain custom projects, we may require:
- Full payment in advance;
- A deposit before work begins;
- Milestone payments;
- Balance payment before final delivery;
- Other payment arrangements agreed with the customer.
For online shop purchases, payment must generally be successfully completed before an order can be processed.
We may use third-party payment providers such as Paystack and PayPal.
17. NON-PAYMENT
Where a customer fails to make a required payment, we may:
- Suspend work;
- Withhold delivery;
- Withhold final files;
- Suspend access to a service;
- Cancel the project;
- Recover amounts legally due to us.
Where applicable, work will resume once outstanding payment requirements have been satisfied.
18. DELIVERY AND SHIPPING
Delivery times depend on the product, supplier, destination, shipping method and other circumstances.
Estimated delivery dates are not necessarily guaranteed delivery dates unless expressly agreed otherwise.
For products supplied through third-party suppliers or fulfilment partners, delivery may be affected by:
- Supplier processing times;
- Courier delays;
- Customs procedures;
- Weather;
- Public holidays;
- Import requirements;
- International shipping conditions;
- Other circumstances outside our reasonable control.
Customers are responsible for providing accurate delivery information.
19. INTERNATIONAL ORDERS

- Customs clearance charges;
- Brokerage fees;

20. THIRD-PARTY SUPPLIERS AND FULFILMENT

Where an issue arises with a third-party supplied product, we will work with the customer and relevant supplier or fulfillment provider to resolve the matter where reasonably possible.
21. RETURNS, REJECTED GOODS AND REFUNDS
Returns, rejected goods and refunds are governed by our separate Return & Rejected Goods Policy, which forms part of the terms applicable to purchases from our website.
Customers should review that policy before placing an order.
Custom-made, personalized, printed or specially produced items may be subject to different return conditions because they have been produced specifically for the customer.
Nothing in this section limits any mandatory rights that a customer may have under applicable law.
22. CANCELLATION OF ORDERS AND SERVICES
A customer may request cancellation of an order or service before production or fulfillment has progressed, but cancellation is not automatically guaranteed.
For custom work, cancellation may be subject to:
- Work already completed;
- Design time already spent;
- Materials already purchased;
- Production already started;
- Supplier costs;
- Shipping costs;
- Other non-recoverable expenses.
Any refund will therefore depend on the circumstances of the cancellation and the applicable refund policy.
23. PRINTING AND COLOUR VARIATIONS
Printed materials may sometimes differ slightly from colours displayed on a computer, phone or other screen.
Differences may result from:
- Screen calibration;
- Printing processes;
- Paper or material;
- Ink or toner;
- Lighting;
- Finishing processes.
Minor variations that are inherent to normal printing processes will not necessarily constitute a defect.
Where exact colour matching is critical, the customer should discuss the requirement with us before production.
24. MEASUREMENTS AND SPECIFICATIONS
For products involving measurements, dimensions, quantities or specifications, customers are responsible for reviewing the information provided before ordering.
For customized printing, signage, packaging or other production work, customers must provide accurate measurements and specifications.
We are not responsible for problems resulting from inaccurate measurements or specifications supplied or approved by the customer.
25. WEBSITE DESIGN SERVICES
Where Bright Eagle Graphic Creations provides website design services, the scope of work will depend on the agreed quotation or project specification.
Unless expressly included in the agreement, website design fees may not automatically include:
- Domain registration;
- Web hosting;
- Premium plugins;
- Premium themes;
- Third-party software subscriptions;
- Paid stock images;
- Email hosting;
- Third-party API services;
- Ongoing maintenance;
- Security monitoring;
- Content creation;
- Search-engine optimization;
- Advertising.
Any additional services or third-party costs will be handled according to the applicable project agreement.
26. WEBSITE MAINTENANCE AND THIRD-PARTY SOFTWARE
Where a website uses WordPress, WooCommerce, plugins, themes or third-party services, those technologies may be updated or changed by their respective developers.
We cannot guarantee that third-party software will remain compatible with every future version of another software component.
Unless maintenance is specifically included in a service agreement, ongoing updates, security monitoring and technical maintenance may constitute separate services.

These Terms, together with any applicable quotation, order information, service agreement, Privacy Policy, Return & Rejected Goods Policy and other policies expressly incorporated into them, constitute the terms governing your relationship with Bright Eagle Graphic Creations in relation to the relevant products or services.
Where a specific written agreement or quotation contains terms that conflict with these general Terms, the specific agreement may take precedence for that particular transaction.
